Terms & Conditions


Please find below the Terms and Conditions for Grosvenor’s Mayfair in Focus photography competition (the “Competition”).


Entering the Competition

  • Closing date for entries is midnight on Mon 5 June 2017. All entries must be received by this time. Grosvenor reserves the right in its absolute discretion to extend the closing date where the entries received are of insufficient quality.
     
  • Entries must be submitted as a high resolution JPEG.
     
  • Entrants may submit multiple entries but only 1 can be shortlisted from any entrant.
     
  • Entries on behalf of another person will not be accepted and joint submissions are not allowed.
     
  • Entries are not allowed from employees of Grosvenor, their families, or anyone else associated with the Competition.
     
  • The Competition is open to all photographers (both amateur and professional).
     
  • You are responsible for the cost (if any) of sending your Competition entry to us.
     
  • Late, illegible, incomplete, defaced or corrupt entries will not be accepted. No responsibility can be accepted for lost entries and proof of transmission will not be accepted as proof of receipt. Entries must not be sent through agencies or third parties.
     
  • Grosvenor reserves the right in its absolute discretion to extend the closing date where the entries received are of insufficient quality.
     
  • We take no responsibility for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.

 

Accepting Terms & Conditions

  • All information detailing how to enter this Competition forms part of these Terms and Conditions. It’s a condition of entry that all rules are accepted as final and that the competitor agrees to abide by these rules. Submission of an entry, via the website or posting a photo on Instagram using the hashtag #Mayfairinfocus, will be taken to mean acceptance of these Terms and Conditions.
     
  • If any part of these Terms and Conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Terms and Conditions conditions will not be affected.

 

Copyright & Permissions

  • All images submitted must be the work of the individual submitting them. It is the responsibility of each entrant to ensure that any images they submit have been taken with the permission of the subject and do not infringe the copyright of any third party or any laws. Entrants must warrant that the photograph they are submitting is their own work and that they own the copyright for it.
     
  • Copyright in all images submitted for this Competition remains with the respective entrants. However, by submitting an entry to the Competition, you grant Grosvenor:
    1. Permission for your entry to be published on Grosvenor websites and you grant Grosvenor a non-exclusive, irrevocable, royalty-free, worldwide, perpetual licence (with a right to sub-license) to use, republish, edit and/or modify your entry in any/all media (including in electronic format, hard copy and in Grosvenor publications) for purposes connected with the Competition and as described in these Terms and Conditions; and
    2. The right to use your name, and country and county/state/city of residence for the sole purpose of identifying you as the author of your entry and/or as a winner of the Competition.
       
  • You hereby waive all your moral rights in your entry. In order to use entries as intended and advised in these Terms and Conditions;
    1. Grosvenor may need to modify entries, including but not limited to resizing, cropping or colour adjustment as necessary, provided that Grosvenor shall endeavour in undertaking such modifications to maintain the integrity of your entry as originally created; and
    2. Grosvenor shall provide a picture credit for all entries.
       
  • You own the copyright to your Competition entry as its author. Your entry must be your own work, must not be copied, must not contain any third-party materials and/or content that you do not have permission to use, must not include any trademarks, and must not show inappropriate or dangerous behaviour, or otherwise be obscene, defamatory, distasteful, offensive, or in breach of any applicable law or regulation, or in breach of any confidentiality obligations owed by you to third parties. If Grosvenor has reason to believe your entry is not your own work or otherwise breaches these Terms and Conditions, then Grosvenor may not consider it and may disqualify it.
     
  • Entrants confirm that each individual whose image is featured in the Competition entry has given consent for the use of his/her image in connection with this Competition and in accordance with these Terms and Conditions. Where an individual whose image is featured in a Competition entry is aged less than 18 years the entrant confirms that the parent or guardian of that individual has given the relevant consent.


Privacy

  • Grosvenor shall use and take care of any personal information you supply to it as described in its privacy policy, a copy of which can be seen at http://www.grosvenor.com/privacy-policy/, and in accordance with data protection legislation. By entering the Competition, you agree to the collection, retention, usage and distribution of your personal information in order to process and contact you about your Competition entry, and for the purposes outlined in these terms and conditions.
     
  • Grosvenor may pass entrants' details to third parties and/or otherwise engage third party providers in connection with this Competition where the third party is acting on Grosvenor's behalf for the purposes of administering this Competition and/or any subsequent publicity, and/or for the purposes of sending you Grosvenor's marketing materials; and/or as otherwise required by law.

 

Prizes

  • Prizes to be confirmed.
     
  • Events may occur that render the Competition itself or the awarding of the prizes impossible due to reasons beyond the control of the Grosvenor and accordingly Grosvenor may at its absolute discretion vary or amend the promotion and the entrant agrees that no liability shall attach to Grosvenor as a result thereof.
     
  • Grosvenor is responsible for the first part of the promotion, which is the promotion and adjudication of the Competition. All other facilities connected with the provision of the prize are the responsibility of the person/company providing the prize.
     
  • The prizes cannot be exchanged or transferred by you and cannot be redeemed by you for cash or any other prize. You must pay all other costs associated with the prize and not specifically included in the prize.
     
  • We retain the right to substitute the prizes with another prize of similar value in the event that the original prize offered is not available.

 

Judging

  • The Judges' decision is final and no correspondence will be entered into.
     
  • The shortlisted entrants will be notified by Grosvenor by telephone or email on or just after 5 June 2017.
     
  • If we can’t get in touch with any of the shortlisted entrants, Grosvenor reserves the right to remove them from the shortlist and another shortlisted entry can be selected.
     
  • It is preferred that all those shortlisted attend the party.


Winner Announcements & Requirements

  • The winner will be announced at the Resident’s Society of Mayfair & St James’s Summer Garden Party on 14 June 2017.
     
  • If the winner does not attend the party, they will be notified by telephone or email on or just after 15 June 2017 to confirm they are the winner. If the winner does not respond to Grosvenor within 21 days of being notified by Grosvenor of their win, then the prize will be forfeited and the Judges shall be entitled to select another winner (and that winner will have to respond to the phone call or email from Grosvenor within 21 days or else they will also forfeit the prize). If a winner rejects the prize or the entry is invalid or in breach of these terms, then the winner's prize will be forfeited and the Judges shall be entitled to select another winner.
     
  • The winner will have their winning photo posted on Grosvenor websites and on Grosvenor social media channels and can be used at Grosvenor’s sole discretion, at a later date. You grant Grosvenor a non-exclusive, irrevocable, royalty-free, worldwide, perpetual licence (with a right to sub-license) to use, republish, edit and/or modify your photo in any/all media (including in electronic format, hard copy and in Grosvenor publications) for such purposes. You hereby waive all your moral rights in your photos. In order to use your photos as intended in this paragraph;
    1. Grosvenor may need to modify your report and photos, including but not limited to resizing, cropping or colour adjustment as necessary, provided that Grosvenor shall endeavour in undertaking such modifications to maintain the integrity of your report and photos as originally created; and
    2. Grosvenor shall provide a picture credit for your photos.
       
  • The winner’s name, and country and county/state/city of residence may be disclosed to anyone who writes within one month after the Competition closing date, stating that they would like details of the Competition winner and enclosing a stamped addressed envelope, to Jen Chassels, Grosvenor, 70 Grosvenor Street, London, W1K 3JP.
     
  • The winner may be required to take part in publicity and promotional activity related to the Competition and the winner shall participate in such activity on Grosvenor's reasonable request. The winner consents to the use by Grosvenor and its related companies, both before and after the closing date of the Competition for an unlimited time, of the winner's voice, image, photograph, name, and country and county/state/city of residence for publicity purposes (in any medium, including still photographs and films, and on the internet, including any websites hosted by Grosvenor and its related companies) and in advertising, marketing or promotional material without additional compensation or prior notice and, in entering the Competition, all entrants consent to the same.

 

Responsibility & Governance

  • Grosvenor accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Competition or accepting any prize. Grosvenor further disclaims liability for any injury or damage to you or any other person's computer relating to or resulting from participation in or downloading any materials in connection with the Competition.
     
  • Nothing in these Terms and Conditions shall exclude the liability of Grosvenor for death, personal injury, fraud or fraudulent misrepresentation as a result of its negligence.
     
  • The Competition and these terms and conditions will be governed by English law and entrants to the Competition submit to the exclusive jurisdiction of the English courts.
     
  • The Promoter of the Competition is Grosvenor Limited whose address is 70 Grosvenor Street, London, W1K 3JP. Any complaints regarding the Competition should be sent to this address.

 

Changes

  • Grosvenor shall not be liable for any failure to comply with its obligations relating to this Competition where the failure is caused by something outside its reasonable control. Such circumstances shall include, but not be limited to, weather conditions, fire, flood, hurricane, strike, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, supervening legislation or any other circumstances amounting to force majeure.
     
  • Grosvenor reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, this Competition with or without prior notice due to reasons outside its reasonable control (including, without limitation, in the case of anticipated, suspected or actual fraud). The decision of Grosvenor in all matters relating to the Competition is final and binding and no correspondence will be entered into.
